These Terms of Use (“Terms”) govern your access to and use of the Smahi Inc website and our apps, including Autipal (together, the “Services”). Please read them carefully. By using the Services, you agree to these Terms.
1. Agreement to these Terms
By downloading, accessing, or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.
2. Eligibility and children
Our apps are designed for children, but accounts, purchases, and agreement to these Terms must be made by a parent, legal guardian, or adult (18+) who accepts these Terms on the child’s behalf and supervises the child’s use. If you are a parent or guardian and permit a child to use the Services, you are responsible for their use.
3. Licence to use the Services
Subject to these Terms, Smahi grants you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial purposes. We reserve all rights not expressly granted.
4. Acceptable use
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the Services.
- Reverse-engineer or attempt to extract source code, except where permitted by law.
- Use the Services to violate any law or infringe anyone’s rights.
- Interfere with or disrupt the integrity or security of the Services.
- Attempt to access accounts or data that are not yours.
5. Purchases, subscriptions, and billing
Some Services or features may be offered for a one-time price or as a family plan. Where you buy through the Apple App Store or Google Play, the purchase is processed by that platform under its terms, and refunds and cancellations are handled according to that platform’s policies. Prices and features may change, and we will describe any recurring charges clearly before you buy.
6. Autipal and support-tool disclaimer
Autipal and our other apps are designed to support children and families — for example with routines, communication tools, and self-regulation aids. They are not medical devices and do not provide medical, psychological, diagnostic, or therapeutic advice, and they are not a substitute for care from qualified professionals. Always seek the advice of a physician, therapist, or other qualified provider with any questions about a child’s health or development. Never disregard or delay professional advice because of something in our apps.
7. Intellectual property
The Services, including software, text, graphics, logos, and the Smahi and Autipal names and marks, are owned by Smahi or its licensors and are protected by intellectual-property laws. You may not use our branding without our prior written permission.
8. Third-party services and links
The Services may link to or rely on third-party platforms (such as app stores and hosting providers). We are not responsible for the content or practices of third parties, and their terms and policies apply to your use of them.
9. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the fullest extent permitted by law, Smahi and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Services. Where liability cannot be excluded, it is limited to the amount you paid us for the Services in the twelve months before the claim.
11. Indemnification
You agree to indemnify and hold Smahi harmless from claims arising out of your misuse of the Services or your violation of these Terms, to the extent permitted by law.
12. Termination
We may suspend or end your access to the Services if you breach these Terms or to protect the Services or other users. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless applicable law requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date above, and continued use of the Services after changes take effect means you accept the updated Terms.
